Luego de que en cuatro ocasiones las autoridades locales les negaran el acceso al matrimonio, Víctor Fernando Urías Amparo y Manuel Aguirre Espinoza se convirtieron en 2015 en la primera pareja conformada por personas del mismo sexo en contraer matrimonio en Baja California.
A casi tres años de este logró, la pareja recibió esta semana la notificación del Quinto Tribunal Colegiado del Decimoquinto Circuito para que procediera el trámite de adopción que promovieron.
En un primer momento solicitaron dicho trámite ante el Sistema Nacional para el Desarrollo Integral de la Familia de Baja California (DIF); no obstante, la instancia se negó a proceder argumentando que la adopción por parte de parejas del mismo sexo no está permitida.
Ante la respuesta del DIF, los hombres interpusieron un amparo; como resultado, el Quinto Tribunal emitió un plazo de tres días para que el procedimiento de adopción avance. Court orders adoption be allowed for first gay couple to marry in Baja California
After local authorities denied them access to marriage four times, Víctor Fernando Urías Amparo and Manuel Aguirre Espinoza became the first same-sex couple allowed to marry in Baja California.
Almost three years after this, the couple received this week the notification of the Fifth Collegiate Court of the Fifteenth Circuit to proceed with the adoption process.
At first, they requested this procedure before the National System for the Comprehensive Development of the Family of Baja California (DIF); however, the court refused to proceed arguing that adoption by same-sex couples is not allowed.
In response to the DIF, the men filed an injunction; As a result, the Fifth Court issued a three-day deadline for the adoption procedure to proceed. In addition, a ruling was passed against the Deputy Attorney for Adoptions for the Defense of Minors and the Family and the Coordination of Adoptions for the Defense of Minors and the Family of the DIF.
According to the ruling, if the resolution is not complied with, and based on Article 192 of the Amparo Law, an estimated fine of 8,000 pesos will be lodged against the officers who do not comply with the amparo ruling. The sentence was issued on February 19 by the judge Dante Orlando Delgado Carrizales before the secretary Ricardo Avila Bailón.
