Peru: Constitutional Court to hold private debate on marriage

The Constitutional Court decided to hold the debate on the lawsuit filed by the Peruvian citizen Óscar Ugarteche , who seeks that the National Registry of Identification and Civil Status (Reniec) recognize his marriage with the Mexican Fidel Aroche.

Carlos Ramos, Eloy Espinosa-Saldaña and Marianella Ledesma voted for the debate to be public ; while against the magistrates José Luis Sardón, Ernesto Blume, Augusto Ferrero and Manuel Miranda .

The case

In 2011, Óscar Ugarteche asked Reniec to register his gay marriage in Mexico, a country where the union between same-sex couples is legal.

However, the registration institution refused and the Peruvian economist decided to judicially appeal the decision when the administrative procedure was exhausted.

In December 2016, the Seventh Constitutional Court of Lima ordered Reniec to recognize and register Ugarteche's marriage . However, in January 2018 the Fourth Civil Chamber of the Superior Court of Lima revoked the order.

The case entered the Constitutional Court in May 2018 and on June 20 of that year the public hearing was held . Since then it has not been resolved.

The journalist Karem Barboza recalled that the speaker in the case is Carlos Ramos Núñez, who in the next few days will send his presentation for debate. So far the date has not been set.

The decision of the constitutional body to debate the case in a reserved manner comes shortly after a group of teachers and lawyers sent a document to President Marianella Lesdesma expressing their concern that more than two years after the lawsuit was filed, it has not yet been resolved .

The statement recalls that "there are binding standards for the Peruvian State regarding the recognition of couples unions between people of the same sex." Read more via La Republica
