Russia: Doctors urge to reject law prohibiting transgender people from marrying

Doctors working with transgender people sent a collective appeal to the State Duma Committee on Health Protection, as well as to the Committee on Family, Women and Children and the chairman of the lower chamber, Vyacheslav Volodin. They called for the rejection of amendments to the Family Code, which would prohibit transgender people from getting married, according to the LGBT group Vykhod.

The appeal was supported by 25 specialists from St. Petersburg, Moscow, Kazan and other regions. Among the signatories are endocrinologists, clinical psychologists, psychiatrists, pediatricians, urologists and plastic surgeons, candidates and doctors of medical sciences.

In their appeal, the doctors wrote that the prohibition on marriages with the participation of transgender people, blocking the procedure for changing documents and forcibly returning the gender indicated at birth in civil status records contradicts the medical and legal practice that has been taking shape in Russia for several decades. Experts also believe that the amendments contradict Article 19 of the Constitution of the Russian Federation on the inadmissibility of discrimination, WHO recommendations, the positions of specialized international medical organizations, the norms of the International Classification of Diseases ICD-10, as well as the federal law "On the Basics of Health Protection in the Russian Federation."

Today, 25 doctors from St. Petersburg, Moscow, Kazan and other regions sent a collective address to the DG Health Committee, as well as to the Committee on Family, Women and Children and the Chairman of the lower chamber Vyacheslav Volodyn, demanding to reject the bill. The signatories include endocrinologists, clinical psychologists, psychiatrists, pediatricians, urologists and plastic surgeons, candidates and doctors of medical sciences. ′′ My patients, transgender and non-binary people receiving hormonal therapy, are among particularly vulnerable groups of the population. They are already forced to constantly undergo excessive procedures, for example, in order to get the conclusion of the medical commission to change passports to relevant name and gender marker. All this significantly increases the level of stress, transgender patients are a high-risk group for the development of depressive disorders and suicidal behavior ′′ - Evdokia Tsvetkova.

Medical professionals call on both committees to give negative feedback on draft laws NN 989008-7, 989011-7 and 989013-7. They indicate that the ban on marriages involving trans * people, blocking the procedure for changing documents and forcibly returning the sex indicated at birth in records civil status acts contradict medical and legal practice, which has been formed in Russia for several decades.

In addition, this is against article 19 of the Constitution of the Russian Federation on non-discrimination, WHO recommendations, positions of relevant international medical organizations on the health of transgender people and the standards of the International Classification of Diseases of ICB-10, as well as the federal law ′′ On the health of transgender people ′′ Basics of health protection of citizens in Russia ".

The requirements of the draft law, which is supposedly to bring the Family Code into line with the amendments to the Constitution of July 4, 2020, are actually partially contradicting themselves, and in other parts unnecessarily, duplicate the existing standards. If adopted, they will only contribute to aggravating the gender dysphoria of trans * people, reducing the quality of life, exacerbating emotional suffering and, in fact, declaring at least thousands of Russian citizens as second-grade people.

Specific manifestations of discrimination will be widespread and daily: for example, the impossibility of legal gender change will dramatically reduce accessibility of medical services not included in the OMS system (due to difficulties with employment in the inconsistency of the ′′ passport ′′ and actual sex), and the ban on even any of the any Marriages for transgender people make it impossible to adopt or guardianship the children of their partners.

The inheritance is questioned, the right not to witness against your loved ones. Finally, a contradictory system of a transgender person's legal personality is being created: one gender will be indicated in the birth certificate and another will be given in the passport.

Reviews on the bill were gathered by relevant committees for the State Duma until August 20, first reading voting on draft laws included in the approximate workplan of the parliament for the fall session.
