RIO — A Medida Provisória 870 , publicada no Diário Oficial da União (DOU) nesta terça-feira, não deixa explícito que a população LGBTI faz parte das políticas e diretrizes destinadas à promoção dos direitos humanos, como constava anteriormente. O Ministério da Mulher, da Família e dos Direitos Humanos no governo do presidente Jair Bolsonaro (PSL) ficará sob a responsabilidade da pastora Damares Alves. A decisão gerou polêmica nas redes sociais e é um dos assuntos mais comentados do Twitter.
Às 19h27, após a publicação desta reportagem, Leonardo Pinho, presidente do Conselho Nacional dos Direitos Humanos, alertou que, no decreto 9.668, também publicado nesta terça-feira do DOU, a promoção dos direitos de lésbicas, gays, bissexuais, travestis e transexuais ficará a cargo de uma diretoria subordinada à Secretaria Nacional de Proteção Global do ministério. Isso, portanto, representa uma perda de status desta população dentro do sistema de proteção dos direitos humanos.
Na MP, o texto cita, especificamente, os direitos "da mulher, da família, da criança e do adolescente, da juventude, do idoso, da pessoa com deficiência, da população negra, das minorias étnicas e sociais e do índio". A respeito deste último, é dito ainda que inclui "o acompanhamento das ações de saúde desenvolvidas em prol das comunidades indígenas, sem prejuízo das competências do Ministério da Agricultura, Pecuária e Abastecimento".
As pessoas lésbicas, gays, bissexuais, transexuais e intersexuais poderiam estar dentro do item "minorias étnicas e sociais", mas a MP sobre o que constitui a área de competência do Ministério da Mulher, da Família e dos Direitos Humanos do novo governo não deixa isso claro. Read more via O Globo
Provisional Measure signed by Bolsonaro does not make explicit guidelines for LGBTI population
RIO - Provisional Measure 870 , published in the Official Gazette (DOU) on Tuesday, does not make explicit that the LGBTI population is part of the policies and guidelines aimed at the promotion of human rights, as previously stated. The Ministry of Women, Family and Human Rights under President Jair Bolsonaro (PSL) will be under the responsibility of Pastor Damares Alves. The decision has generated controversy in social networks and is one of the most talked about subjects on Twitter.
At 19h27, after the publication of this report, Leonardo Pinho, president of the National Human Rights Council, warned that in Decree 9.668, also published on Tuesday, the promotion of the rights of lesbian, gay, bisexual, transvestite and transsexual will be in charge of a directorate subordinate to the National Secretariat of Global Protection of the ministry. This, therefore, represents a loss of status of this population within the system of protection of human rights.
In the MP, the text specifically cites the rights "of the woman, the family, the child and the adolescent, the youth, the elderly, the disabled, the black population, the ethnic and social minorities and the Indian". Regarding the latter, it is also said that it includes "the monitoring of health actions developed for the benefit of indigenous communities, without prejudice to the competencies of the Ministry of Agriculture, Livestock and Supply".
Lesbian, gay, bisexual, transsexual and intersex people could be included in the item "ethnic and social minorities", but the MP on what constitutes the area of competence of the Ministry of Women, Family and Human Rights of the new government does not leave that's clear.
