United Nations calls to investigate and punish hate crimes
The United Nations System in El Salvador calls on national authorities responsible for investigating these crimes to punish the perpetrators, to recognize transphobia as aggravating, and to take urgent measures to prevent further acts of violence based on prejudice and hate against the LGBTI community.
The United Nations System in El Salvador is deeply concerned about the recent killings of people from the lesbian, gay, bisexual, trans and intersex (LGBTI) community: Anahí Miranda Rivas, Jade Camila Díaz, Victoria Pineda and Óscar Cañenguez; and expresses its condolences and solidarity with the families of the victims, their loved ones and activists for the defense of human rights.
According to data from the National Civil Police, between 2014 and 2018, 40 LGBTI people were killed. In 2017, the Salvadoran State appeared before the Inter-American Commission on Human Rights, reporting that only 11% of the 109 cases of homicide against LGBTI persons, investigated to that date, had been brought to trial.
The independent expert on protection against violence and discrimination based on sexual orientation and gender identity, Víctor Madrigal-Borloz recommended that the UN member states legislate against crimes motivated by prejudice, describing transphobia as aggravating in the imposition of the penalty, action that the Salvadoran State took in 2015 incorporating this aggravating in articles 129 and 155 of the Criminal Code of El Salvador.
Madrigal-Borloz urged, in addition, to take all necessary measures to prevent, investigate and punish acts of violence and discrimination based on gender identity, regardless of who commits them and in the sphere of action in which they occur, thus how to offer reparation to the victims of such acts.

In addition, it urges all sectors of society to promote respect for life, physical and mental integrity, and in general to defend the human rights of people regardless of their sexual orientation or gender identity.
El Sistema de las Naciones Unidas en El Salvador hace un llamado a las autoridades nacionales encargadas de investigar estos crímenes para que sancionen a los autores, considerando la transfobia como agravante, y tomen medidas urgentes para prevenir más actos de violencia basados en el prejuicio y el odio contra la comunidad LGBTI.
El Sistema de las Naciones Unidas en El Salvador está profundamente preocupado por los recientes asesinatos de personas de la comunidad de lesbianas, gais, bisexuales, trans e intersexuales (LGBTI): Anahí Miranda Rivas, Jade Camila Díaz, Victoria Pineda y Óscar Cañenguez; y expresa sus condolencias y solidaridad con las familias de las víctimas, sus seres queridos y activistas para la defensa de derechos humanos.
De acuerdo con datos de la Policía Nacional Civil, entre 2014 y 2018, 40 personas LGBTI fueron asesinadas. En 2017 el Estado salvadoreño compareció ante la Comisión Interamericana de Derechos Humanos reportando que solo el 11% de los 109 casos de homicidio contra personas LGBTI, investigados a esa fecha, habían sido llevados a juicio.
El experto independiente sobre la protección contra la violencia y la discriminación por motivos de orientación sexual e identidad de género, Víctor Madrigal-Borloz recomendó a los Estados miembros de la ONU que legislen contra los delitos motivados por prejuicios, calificando la transfobia como agravante en la imposición de la pena, acción que el Estado salvadoreño tomó en el 2015 incorporando este agravante en los artículos 129 y 155 del Código Penal de El Salvador.
Madrigal-Borloz exhortó, además, a tomar todas las medidas necesarias para prevenir, investigar y sancionar los actos de violencia y discriminación por motivos de identidad de género, independientemente de quién los cometa y en la esfera de acción en la que se produzcan, así como ofrecer reparación a las víctimas de tales actos.

Además, insta a todos los sectores de la sociedad a promover el respeto a la vida, la integridad física y mental, y en general a defender los derechos humanos de las personas sin importar su orientación sexual o identidad de género.
