O ministro Celso de Mello, do Supremo Tribunal Federal (STF), votou nesta quarta-feira (20) para enquadrar a homofobia e a transfobia (intolerância contra transexuais) como crime de racismo até que o Congresso Nacional aprove uma legislação específica para o tema. Na prática, o magistrado recomendou aos colegas de tribunal a criminalização do preconceito e da discriminação contra a comunidade LGBTI.
Foi o terceiro dia de julgamento das duas ações apresentadas pelo Partido Popular Socialista (PPS) e pela Associação Brasileira de Gays, Lésbicas e Transgêneros (ABGLT) que pedem a criminalização de todas as formas de ofensas, individuais e coletivas, homicídios, agressões e discriminações motivadas pela orientação sexual e/ou identidade de gênero, real ou suposta, da vítima.
O julgamento foi novamente suspenso e deve ser retomado nesta quinta-feira (21). Até o momento, apenas Celso de Mello – relator de uma das ações – votou. Ainda devem apresentar o voto o relator da outra ação, ministro Edson Fachin, e os outros nove magistrados da Suprema Corte.
Na sessão desta quarta, Celso de Mello reconheceu a omissão e a demora inconstitucional do Legislativo em votar a criminalização. Segundo ele, "mostra-se indispensável que o estado proteja os grupos vulneráveis".
Em seu voto, o decano (integrante mais antigo do tribunal) argumentou que, caso determine a criminalização da homofobia, o Supremo não criará nenhuma norma penal – o que é competência exclusiva do Legislativo – somente enquadrará a discriminação contra homossexuais em uma lei já existente.
"Atos de homofobia e transfobia constituem concretas manifestações de racismo, compreendidas em sua dimensão social, o racismo social", ponderou o magistrado.

Brazilian Supreme Court (STF) Minister Celso de Mello on Wednesday voted to frame homophobia and transphobia (intolerance against transsexuals) as a crime of racism until Congress approves legislation specific to the subject . In practice, the magistrate advised court mates to criminalize prejudice and discrimination against the LGBTI community.
It was the third day of the trial of the two actions presented by the Popular Socialist Party (PPS) and the Brazilian Association of Gays, Lesbians and Transgenders (ABGLT) that demand the criminalization of all forms of individual and collective offenses, homicides, assaults and discriminations motivated by the sexual orientation and / or gender identity, real or supposed, of the victim.
The trial was suspended again and should be resumed on Thursday (21). So far, only Celso de Mello - rapporteur for one of the actions - voted. The rapporteur for the other action, Minister Edson Fachin, and the other nine justices of the Supreme Court must still present the vote.
In the session of this Wednesday, Celso de Mello recognized the omission and the unconstitutional delay of the Legislative in voting the criminalization. According to him, "it is essential that the state protects vulnerable groups".
In his vote, the dean (the oldest member of the court) argued that if he determines the criminalization of homophobia, the Supreme will not create any criminal law - which is the exclusive competence of the Legislature - will only frame discrimination against homosexuals in an existing law .
"Acts of homophobia and transphobia are concrete manifestations of racism, understood in their social dimension, social racism," said the magistrate.
