Corte rechaza recurso: Autores de "Nicolás tiene dos papás" no pueden casarse
"Las normas sobre estado civil vigentes en nuestra legislación nacional, son de orden público, de manera que no puede disponerse por voluntad de las personas ni tampoco puede existir una interpretación extensiva de ellas", sostiene el fallo.
La Corte de Apelaciones de Santiago rechazó el recurso de protección interpuesto en contra del Servicio de Registro Civil por el periodista Ramón Alberto Gómez Roa (43) y el diseñador Gonzalo Velásquez Velásquez (37), a quienes se le negó hora para contraer matrimonio.
En fallo unánime, la Octava Sala del tribunal de alzada –integrada por los ministros Juan Cristóbal Mera, Mireya López y la abogada (i) Paola Herrera– descartó el actuar arbitrario del servicio recurrido al negar la solicitud efectuada por los profesionales autores del cuento "Nicolás tiene dos papás".
"Las normas sobre estado civil vigentes en nuestra legislación nacional, son de orden público, de manera que no puede disponerse por voluntad de las personas ni tampoco puede existir una interpretación extensiva de ellas", sostiene el fallo.
En ese sentido, menciona que el artículo 102 del Código Civil refiere que "el matrimonio es un contrato solemne por el cual un hombre y una mujer se unen actual y e indisolublemente, y por toda la vida, con el fin de vivir juntos, de procrear y de auxiliarse mutuamente".
Añade que "se está en presencia de un acto emanado de autoridad competente, es decir, dando cumplimiento en forma estricta a lo dispuesto por los artículos 6° y 7° de la Constitución Política de la República, situación que descarta de inmediato la supuesta ilegalidad".
