En este documento lamentan la “indolencia y negligencia” de las instituciones por no resguardar y garantizar los derechos de les niñes y adolescentes trans en el contexto escolar. “Esto sólo demuestra el fracaso del sistema educacional en relación al resguardo y garantía de la vida y salud mental de nuestres niñes, transgrediendo así su bien superior y diversas normas del derecho internacional”, expresaron.
La Ley de identidad de género, recientemente promulgada, no considera un procedimiento de cambio de nombre y sexo registral para niñes menores de 14 años; a lo que se suma la insuficiente aplicabilidad de la circular 0768 de la Superintendencia de Educación para estudiantes trans. “Los colegios, especialmente los establecimientos educacionales privados y/o confesionales, no se encuentran familiarizados con esta y no tienen una capacitación en general para cumplirla”, indican.
