Brazil: National LGBTI Institutions Repudiate Brazil's Omission in Signing the LGBTI + Action Plan in Mercosur

JOINT PUBLIC NOTE IN THE FORM OF DENUNCIATION TO THE BRAZILIAN LGBTI + POPULATION AND IN REPUDITION THE OMISSION OF THE BRAZILIAN STATE IN A MEETING ON THE PROTECTION OF LGBTI + PEOPLE WITH MERCOSUR COUNTRIES

The institutions that collectively sign this note come to the public to call the attention of the Brazilian LGBTI + population, as well as researchers, allies, legislators and members of the judiciary, executive and other areas of defense of human rights that BRAZIL REFUSED USE OF THE TERMS GENERAL IDENTITY, EXPRESSION OF GENDER AND HATE CRIMES against the LGBTI + population in the work plan discussed at a meeting at the Permanent Commission for LGBTI People with the highest human rights authorities in MERCOSUR diverging from countries such as Argentina, Uruguay and Paraguay on the theme.

It is appalling that in the same year that there was an increase of close to 70% in the cases of murders of transvestites and trans women between the months of January and August 2020, compared to the same period last year, Brazil makes such a decision ignoring that Transfeminicide is the systematic murder of the trans population motivated by hatred and repulsion to gender identity and expression. Trans people are killed for expressing a gender identity that differs from that imposed on them at birth and for doing so publicly. , Brazil remains a sad leader in the murders against trans people in the world in the last ten years, without the Brazilian state taking any initiative to combat this violence.

In the most recent version of the Atlas of Violence, published by the Brazilian Public Security Forum, the neglect of Brazilian states in relation to the lives of transgender people is clear, when it is noticed that 15 of them do not even survey data on lgbtifobia violence and none of the 26 states plus the Federal District brought data on the murder of LGBTI + people. Demonstrating, therefore, that underreporting and neglect of LGBTIphobic violence is still present in the government's mode of action.

The current Brazilian government does not recognize the citizenship of the population of lesbians, gays, bisexuals, transvestites, transsexual women, trans and intersex men (LGBTI), because in addition to not allocating resources, actions and projects in defense of the LGBTI + population, it has worked tirelessly to deny their access to basic rights, promoting setbacks in the achievement of pro-LGBTI policies.

This setback and denial of rights is seen especially by the Ministry of Women, Family and Human Rights, which in its management does not promote policies to combat LGBTphobic and / or gender-based violence - which have been increasing since the beginning of its management -; delegitimizing the evidence of vulnerability of this population, in addition to extinguishing public policies and channels of social participation that sought to ensure and recognize their full citizenship.

We believe that the management in force is contrary to the principles consolidated in the democratic rule of law and violates Article 5 of the Constitution. Furthermore, it disagrees with several international treaties to which Brazil is a signatory, such as the Yogyakarta principles, the principles of the Inter-American Court of Human Rights in Advisory Opinion No. 24, which deal with gender identity issues and the non-discrimination of couples. of the same sex (IACHR, 2017), as well as the recommendations of the UN itself in defense of the LGBTI population.

We understand that the omission regarding the topics proposed at the meeting of the LGBTI + Permanent Commission at the Mercosur meeting is related to the innumerable LGBTIphobic, sexist and / or racist statements by the President and agents of his government, as well as by Minister Damares Alves, who disseminate, legitimize and authorize various forms of violence against the LGBTI + population. We identified correlations between hate statements by the government and the increase in cases of LGBTIphobic violence, as well as the use of the phrase “gender ideology” in order to foster panic, fear and stigma in relation to the population of transvestites and transsexuals.

It is worth mentioning that every 48 hours a transsexual person is savagely murdered in Brazil and that this year we already have more cases than in the entire year 2019, exceeding 140 murders. Still, according to the most recent estimates, we have accumulated 82% of school exclusion for transvestites and transsexuals, a panorama that increases the vulnerability of this population and favors the high levels of violence that we are exposed to in the day-to-day traffic exactly because of the hatred of our identity of gender. There is no way to discuss an effective confrontation of violence, specifying that this population suffers without naming it or instrumentalizing state agents to have data on how violence has victimized the Brazilian trans population.

Our public repudiation remains the inaction and inaction of the Ministry of Women, Family and Human Rights, which has used its employees to oppose the advances in the achievements of rights of the LGBTI + population and here we explicitly repudiate those who were representing Brazil at that meeting, opposite side of the defense of the human rights of the trans population, namely: Marina Reidel - Director of Promotion of LGBT Rights, Vitor Marcelo Almeida - Special Adviser on International Affairs, Douglas Rodrigues - Coordinator of International Affairs, from the Ministry of Women, Family and Rights Human Rights, and Daniel Leão of the Human Rights Division of the Ministry of Foreign Affairs.

While the blood of Transvestites, Transsexual women, Trans men and other trans people is in your hands, we will continue to resist you and them!
