The Senate Constitution Commission began to review in particular today the equal marriage project, which was entered in 2017 during the government of Michelle Bachelet .
The minister of the Segegob, Jaime Bellolio , was invited to the instance , but the Secretary of State excused himself from attending because at the same time he had to present his portfolio budget.
The initiative on equal marriage, which is in its first legislative process and without urgency, has been an issue that has complicated the Sebastián Piñera administration on more than one occasion, considering the division that this issue generates in the center-right. In this sense, the Executive has expressed on multiple occasions against advancing the measure, arguing that it is not part of the government program.
However, in La Moneda they say that this scenario could change. A few days ago, the President raised in a meeting with his political committee ministers that the government's position on equal marriage had to be reviewed. Without going into more details, the Head of State stated that it is an issue that they should discuss.
Government sources say that the episode reveals the intention of the Head of State to analyze the matter again and the position that La Moneda has had, which has been questioned on several occasions by the opposition and by LGBTI movements.
In fact, one of the most controversial moments was when in 2018 the government, through the Human Rights Undersecretariat, modified the human rights plan and, instead of stating that they will promote the project, they indicated that they will only monitor its progress . “The equal marriage bill is in Congress. That is to say, that today no longer corresponds to the Executive. Furthermore, it is sufficiently public knowledge that it is not in the government program of President Piñera, ”said Undersecretary Lorena Recabarren that time.
The controversy regarding this position lies in the fact that in 2016 the Bachelet government -on behalf of the Chilean State- signed with the Homosexual Integration and Liberation Movement (Movilh) a friendly settlement agreement before the Inter-American Commission on Human Rights (IACHR) . This pact implied that the Movilh withdrew a lawsuit against the State that had been filed in 2012, in exchange for a commitment to equal marriage, among other points.
