Spain: The Government begins the judicial process against the 'parental pin' of Murcia

The Government has filed a contentious-administrative appeal Tuesday before the Superior Court of Justice of Murcia against the resolutions of the regional Ministry of Education and Culture on the 'parental pin' (parental permission for their children to attend activities organized during school hours).

As RTVE has been able to confirm, it has also been requested, "as a matter of urgency", the adoption of  precautionary measures consisting in the suspension of the instructions issued on the permit.

Minister Isabel Celaá gave the region a month to withdraw the veto

The appeal is filed  after Murcia has not responded to the request sent on January 17  by the department to withdraw the parental pin. 

The president of the Region of Murcia, Fernando López Miras, said last Friday that he  will only withdraw the 'parental pin' if the judicial instances so determine.  "We are not going to do it because it is said by a government that does not believe in what we believe, such as the freedom of fathers and mothers," said Miras.

And, for his part, the Minister of Presidency and Finance,  Javier Celdrán , reiterated on Monday that the Murcian government will not withdraw parental leave unless required by a judicial instance and has said they have the “peace of mind” of having guarantees legal and inspection for that measure.

Minister Isabel Celaá has stressed in several statements that parents are not asked for permission for "voluntary activities, but complementary activities, which are compulsory and valuable curriculum subjects".

A measure also rejected by the educational community

For the head of Education, the instruction of the Murcia Government "is to invent a problem that undermines the competence of schools, the educational community and goes against the freedom of professors' professors."

Celaá gave Murcia, in January, a month to "restore legality" and  withdraw the parental veto before resorting to the courts  as has finally happened.

The controversial 'parental pin' is a measure  proposed by Vox and supported by the PP  that aims to force the management of educational centers to have to report on any subject, talk, workshop or activity that affects gender identity issues, feminism or LGBTI diversity to parents to obtain their express consent.

The measure, which involves a ban on certain educational content,  would affect activities organized during school hours  and, therefore, unlike extracurricular ones, mandatory for all students.

Murcia will not remove the parental pin unless required by a court order

The controversy over the parental pin continues to increase. The president of the Region of Murcia, Fernando López Miras, has reiterated that the Ministry of Education will not withdraw the parental pin unless required by the judicial authorities.

The parental pin implies that parents with underage children must issue authorisations since September for their children to attend complementary activities in schools. López Miras defends that the decision taken to impose the parental pin is legal and that it has favourable reports from the legal services of the counselling and from the educational inspection.
